By accessing or using MarketMine ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 18 years of age to use MarketMine. By using the Service, you represent and warrant that you meet this requirement.

MarketMine is an AI-powered digital product research tool that helps users identify market opportunities, generate product ideas, create content outlines, and develop pricing strategies for digital products including guides, ebooks, and templates.

The Service is powered in part by third-party AI technology. Results are generated automatically and are provided for informational and research purposes only. We do not guarantee the accuracy, completeness, or commercial viability of any output generated by the Service.

Access to MarketMine requires a one-time payment processed through Stripe, our third-party payment processor. Upon successful payment, you will receive access to the Service.

You are responsible for maintaining the confidentiality of your access credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@marketmineapp.com of any unauthorized use of your account.

You may not share, sell, transfer, or sublicense your access to the Service to any third party.

All purchases are final. Due to the nature of digital products and the immediate access granted upon payment, we do not offer refunds once access to the Service has been granted.

Before completing your purchase, we encourage you to review the Service description, features, and any available previews to ensure the Service meets your needs.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Generate, distribute, or promote illegal, harmful, or fraudulent content
• Attempt to reverse engineer, scrape, or extract the underlying AI models or systems
• Resell, sublicense, or commercially redistribute access to the Service
• Use automated scripts or bots to make requests to the Service
• Interfere with or disrupt the integrity or performance of the Service

We reserve the right to suspend or terminate your access without notice if we determine, in our sole discretion, that you have violated these Terms.

The Service, including its design, code, branding, and underlying technology, is owned by MarketMine and protected by applicable intellectual property laws.

Content you generate using the Service ("Output") is yours to use for personal and commercial purposes. You retain full ownership of any digital products, guides, or other content you create using Output from the Service.

You grant us a non-exclusive, royalty-free license to use anonymized, aggregated usage data to improve the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any results obtained from the Service will be accurate, complete, or commercially viable. Market research outputs are AI-generated and should be independently verified before making business decisions.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARKETMINE AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid for access to the Service.

The Service integrates with third-party services including Stripe (payment processing) and Anthropic (AI technology). Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party services.

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
